1. About this agreement
This agreement is between you and [Flendy legal entity name] (“Flendy”, “we”), RC [RC number], [registered address]. It applies when you use Flendy as a creator or clipper, on the web at flendy.co/creator or in the Flendy app. The acceptable use policy and the disclosure guidelines are part of it. How we handle your data is in the privacy policy.
2. Joining
- You must be 18 or over. We don’t accept creators under 18, even with a parent’s permission.
- There’s no follower minimum. Use your real name and accurate details; your public profile shows your handle, city, niches and stats.
- To earn from views you must connect the account you post from (TikTok, Instagram or YouTube) so we can read your posts’ view counts. We only ask for read access. We never post for you.
- If we made a profile for you from your public page, claiming it means you accept this agreement. Until you claim it, you can ask us to remove it.
3. You're independent
You’re an independent contractor, not an employee, agent or partner of Flendy or of any brand. You decide whether to take work, how you make it and when you work, within what you agree. You’re responsible for your own equipment, costs, tax and any permits. Nothing here makes Flendy your manager or talent agency.
4. Campaigns, offers and deals
- Views and clipping campaigns: you join, post from your connected account and earn per 1,000 verified views at the rate shown, in milestones.
- Offers: brands can send you an offer for a collab, UGC or product seeding. You can accept, counter or decline. You can also apply to open campaigns with a pitch and your price.
- An accepted offer is a deal between you and the brand on the terms shown: the deliverables, dates, fee, usage rights and number of revisions. Flendy runs the deal, holds the brand’s budget and pays you.
- Deliver what you accepted, on time. When you deliver, the brand approves it or asks for changes within the agreed revisions. Approval releases your fee. If a campaign doesn’t need approval, the fee is released when you post.
- If you can’t deliver, say so in the chat as early as you can. Either side can ask Flendy for help from the deal, and we’ll decide fairly.
- For product seeding, the brand sends the product to the address you give. The product is yours to keep unless the deal says otherwise.
5. Verified views and milestones
- A verified view is one the platform reports for a post from your connected account that has passed our checks. We read your posts’ numbers on a schedule.
- Each time a post’s verified views pass a milestone (1K, 5K, 10K and up), the pay for that step is added to your balance as on hold. Pay is never rounded up to a milestone you haven’t reached.
- Each campaign shows its rate, milestone ladder and any per-creator cap before you join. When a campaign reaches its target or end date, later views don’t earn.
- Your first approved post to pass 1K views earns a one-off ₦2,000 bonus.
- Keep campaign posts up and public for at least 30 days after posting, and don’t edit out the brand, the campaign tag or the label.
6. Fees: you keep 95%
- For fee-based work (collabs, UGC, paid seeding) Flendy takes a 5% processing fee from the agreed fee. Every offer shows what lands with you, for example “₦47,500 to you · ₦50,000 offer · 5% processing”.
- For views campaigns, the rate per 1,000 views you see is what you earn; there’s no extra fee taken from it.
- Next-day withdrawals are free. Instant withdrawals, where offered, cost 1.5% of the amount.
7. The hold and fraud checks
- Earnings stay on hold for 7 days while we check the views and work are real. Your balance shows what’s on hold and the day it clears. Then it becomes available to withdraw.
- Our checks look at things like sudden spikes in views, engagement far below normal, the same video posted from other accounts, very new accounts, and differences between the platform’s count and the public count.
- A post that’s flagged stops earning until a person reviews it. If it’s found to be fake, its earnings are reversed and the money goes back to the brand. You’ll be told why, and you can ask us to look again.
8. Payouts and identity checks
- You can withdraw from ₦1,000 to a Nigerian bank account in your own name. We check the name on the account with the bank.
- Before your total withdrawals pass ₦50,000, we’ll ask you to verify your identity: either the name on your bank account matches your Flendy name, or you verify your BVN. BVN checks are done through Paystack. We keep only the last 4 digits.
- Withdrawals are paid by bank transfer, usually within one working day. We’ll tell you when money is on its way, with the reference.
- If we pay you by mistake, or for views later found to be fake, we may take it back from your balance or ask you to return it.
9. Tax
You’re responsible for declaring and paying any tax on what you earn, including income tax and, if you’re registered, VAT. Where the law requires us to deduct tax (for example withholding tax) or report payments to the tax authority, we will, and we’ll show it on your statement. You can download your earnings history from your account.
10. Your content and usage rights
- You own what you make. You confirm it’s your own work and that you have the rights to any music, people and places in it.
- Campaign posts on your account: the brand and Flendy may share, embed and link to them, and show them in reports, for 12 months.
- UGC: when the brand approves a UGC delivery, they get a non-exclusive licence to use it in their own channels and paid ads for the usage period shown on the deal. Anything longer needs a new agreement.
- Ads from your own post only happen if you give the brand an ad code through whitelisting, for the duration you choose (7, 30, 60 or 365 days). That pays a ₦5,000 bonus and a share of ad spend, shown before you agree.
- You let Flendy show your public profile, stats and campaign posts on Flendy, so brands can find you.
11. Disclosure
Every campaign post is advertising. Label it clearly with the platform’s paid partnership label and #ad (or #gifted for free products), as described in the disclosure guidelines. This is what ARCON and the platforms expect. For regulated products (alcohol, financial products, medicines), follow the brand’s approved wording exactly and only make claims you believe are true.
12. Content standards and takedowns
Your content and conduct must meet the acceptable use policy. In particular, these get you removed:
- buying views, likes or followers, or using bots, view farms or engagement groups;
- posting someone else’s video, or the same clip from several accounts;
- deleting or hiding a campaign post within 30 days of posting it;
- misleading claims about a brand’s product, or hiding that a post is paid.
If a brand, a platform or a rights holder tells us content breaks the rules or someone’s rights, we may ask you to take it down or edit it, and pause earnings on it until it’s sorted.
13. Leaving and termination
- You can leave at any time from Settings (in the app) or your profile (on the web): see how to delete your account. Finish or cancel running deals first. Available earnings are paid out first; earnings on hold are paid once their checks clear.
- You can disconnect a social account at any time. Posts from it stop being counted from then on.
- We may pause or close your account for serious or repeated breaches, fraud, or if the law requires it. Earnings from fraud are not paid. Earnings from genuine work are paid out, less anything you owe.
14. Our responsibility
- We can’t promise how many campaigns or offers you’ll get, or how many views your posts will get.
- We’re not responsible for the platforms’ outages, changes to their numbers, or a brand’s products, though we’ll act on problems you report.
- Our total liability to you is limited to the earnings due to you that we haven’t paid. Nothing here limits liability that the law doesn’t allow us to limit.
15. Changes, disputes and law
- We’ll tell you by email or in the app before material changes apply. Work you’ve already accepted keeps the terms it was agreed on.
- Problems? Tell us first at hello@flendy.co or with “Get help” on a deal. We’ll reply within 5 working days.
- This agreement is governed by the laws of the Federal Republic of Nigeria, and the courts of Lagos State have jurisdiction.
